ANTC Constitution
CONSTITUTION ALGONQUIN NATION TRIBAL
COUNCIL (Reaffirmed - March 11, 2005)
I. MISSION STATEMENT
To secure an acceptable Land Claim Treaty Settlement in a manner that
represents the best interests of the Algonquin Nation of Ontario and our
future generations while promoting fairness, accountability and unity within
the Algonquin Nation.
II. GUIDING PRINCIPLES
The priman Principle of the ANTC is that the Negotiations are conducted in a
manner that represents the best interests of the Algonquin Nation. The Guiding Principles of the ANTC are:
1.1 Algonquin title remains intact.
1.2 A Nation to Nation/ Government to Government relationship exists between
Canada/Ontario and the Algonquin Nation of Ontario.
1.3 Algonquin title to any of the Algonquin Nations territory is not to be
extinguished.
1.4 The three strands of the Sweetgrass Braid signify each of the three
governments in this negotiation. As those strands are woven together to form
a braid, so too
are the interests of the three governments woven together through the
negotiation process. The result will be a braid that will provide the
strength of the three
interests combined, while allowing each to remain separate and distinct from
the other two.
1.5 Economic non-dependence as a people, now and for future generations.
1.6 Respect for, and protection of, Algonquin culture and traditions,
including respect for all living things.
1.7 Recognition and protection of any rights of other Algonquin communities.
1.8 Fairness in respecting innocently acquired rights of Third Parties
within Algonquin Territory. The Algonquin Nation will consider the needs of
modern society,
and shall endeavor to address those needs in any final settlement.
1.9 All Algonquins must have equal rights and equal access to the ANTC.
1.10 The ANTC must be accountable politically, financially and
administratively.
1.11 The ANTC must be based upon respect for all Algonquins, whether born
or unborn, all other people, and the natural world.
1.12 The ANTC should be as simple as possible, consistent with the Algonquin
history of having only as much government as Algonquins need.
1.13 The ANTC must represent Algonquins fairly and inclusively.
1.14 The ANTC must be open and accessible to all Algonquins.
1.15 The ANTC must consist of representation from national and regional
bodies, and all Algonquin political representatives must represent both
their regional
constituents and the Algonquin Nation as a whole. MEMBERSHIP
Membership in the ANTC shall consist of representatives from each Region
and/or community of the Algonquin Nation of Ontario, namely: (1) Sharbot Mishagama Anishinabe Algonquin First Nation; (2) Mattawa/North Bay First Nation; (3) Algonquins of Greater Golden Lake First Nation (4) Ardoch Algonquin First Nation; (5) Antoine First Nation; (6) Bonnechere Algonquin First Nation (7) Any other Region that meets the approved Criteria. NATION REPRESENTATIVES Roles and Responsibilities
l. Must be democratically elected by the Algonquins of their Region.
2. Shall act under the direction of their Region.
3. Shall deliver Regional concerns in a clear and precise manner.
4. Spokesperson for the Region.
5. Defend and negotiate Regional concerns, proposals, and positions when
necessary.
6. Direct negotiations toward a treaty settlement.
7. Update the Region on the status of negotiations
8. Spokesperson y in dealing with ministries, associations, clubs and
corporations in the Regions.
9. Work with the chairpersons of the committees to facilitate meetings and
workshops.
10. Must have a general knowledge of negotiations issues.
11. Attend court hearings whenever requested or required.
12. Holds various Portfolios as required.
13. Participate on sub committees and Task Forces.
14. Reports economic or employment opportunities available to Algonquins.
15. Help to develop national and regional political strategies.
16. Attend all Algonquin political meetings as possible.
17. Submit annual regional budget and financial statement of expenditures
18. Provide direction to any Algonquin associations and corporations.
19. Provide direction to ANND
.20. Shall participate in the development and enactment of Algonquin Laws
and the development of the Algonquin Nation Government.
Selection:
The Algonquin Nation Representative shall be elected according to the
Algonquin Nation Tribal Council Standardized Election rules. Term:
The term of Office for the Algonquin Nation Representative shall be from the
signing of the accord or from September 21, 2002 with the presentation of
125 Representation Forms.
Each elected Nation Representative shall serve from the election date of
October 23, 2004 to October 23, 2007 or when ANTC deems an election, shall
be called,
under the Algonquin Nation Election Rules. The position of Nation
Representative shall be automatically vacated: Admission Criteria:
Regions/Communities are eligible to join the Algonquin Nation Tribal Council
if they:
• Demonstrate that they represent a minimum of 125 Algonquin persons who are
from more than a single family.
• Demonstrate that they are a community based on territory, which is to say
that they have a land base having explicit and/or implicit boundaries
connected to the
territory under discussion. Recognition will be based on relevant and
validated historical traditional use within these boundaries. • Demonstrate
that they are a
community based on being a relevant distinct group of people, characterized
by relationships among member units that are not usually formally or
contractually
based; rather the relationships are symbiotic (interdependent) and pertain
to the needs of those sharing the same habitat.
• Can derive a formally constituted goal structure from the common needs
and problems faced by the people sharing the same habitat.
• Demonstrate that they integrate the social units in two general ways: (1)
through sharing similar culture, and (2) through interdependent
relationships. Demonstration of Representation:
The only way that an accepted representation form shall be considered valid
is if the Nation Representative can provide a signed representation forms
from an
identified Algonquin persons. Algonquin Persons:
Algonquin persons are defined as all Algonquins who are enrolled or eligible
to be enrolled under the former Algonquin Enrollment Law or the current
Algonquin
Nation Tribal Council Identification Criteria or any future Standardized
Algonquin Identification Criteria of the ANTC. Transition:
In recognition that it will take time to fully implement this Constitution,
all persons recognized by the ANTC as being a representative of Algonquin
persons shall be invited to join the ANTC and to sign an accord with the
ANTC immediately.
Each Nation Representative who is a party to the ANTC and each new community
that joins the ANTC shall have until October 21, 200 5 to meet the minimum
requirements of representation to remain a Nation Representative on the ANTC.
When the Nation Representative demonstrates that she/he does meet the
minimum requirements, his/her name shall stand until October 21, 2007 unless
the Nation
Representative resigns, dies, becomes incapacitated or if 50% plus 1 of the
region/community identified Algonquin members decide that an election shall
be held.
Currently recognized communities cannot intentionally break into splinter
groups to increase the number of seats that the community will occupy.
Nation
Representatives "' will refrain from soliciting members of other communities
to change representation.
In the event that recognized Nation Representative does not achieve the
minimum requirements to remain a Nation Representative by October 21, 2005,
the ANTC shall decide whether an election shall be held in that
Region/community or if, in the case where there are insufficient numbers of
Algonquins
in the area, whether the Algonquin persons would more appropriately
represented some other way.
